1. SCOPE OF TARIFF This tariff applies to busking, whether or not a charge is made for the performance, in any place indoor and/or outdoor not otherwise adequately covered by a licence from the Society. 2. ROYALTY RATES 2.1 All royalties are charged at the royalty rate in force at the beginning of the License Year, and are payable in advance of the License Year. 2.2 The royalty rates payable under this tariff for a License Year is as follows: Background Music (Mechanical Performance)/Live Music Performance:
3.1 Applicants for a Permit under this tariff are required to give this Society such information on the Society’s appropriate forms as may be necessary to enable the Society to decide whether the tariff is applicable. 4. DEFINITION For the purposes of this tariff: 4.1 The “Society’s Repertoire” means all or any musical works and literary works which are lyrics to musical works, of which the right of public performance in the Macau Special Administrative Region is or may be controlled by the Society or any societies in places other than the Macau Special Administrative Region with which the Society is affiliated from time to time. 4.2 “Busking” means that the “Busker” who got the “Busking Points” document issued by the Cultural Affairs Bureau of the Macau Special Administrative Region and to perform street performance at designated public places and time periods. 4.3 “Society” means Macau Association of Composers, Authors & Publishers (MACA). |

1. SCOPE OF TARIFF This tariff applies to causing the Society’s Repertoire given in the course of, or in connection with, the exhibition of cinematographic films/audiovisual works, at cinemas or other premises at which under the commercial exhibition of cinematographic films/audiovisual works regularly takes place. Licenses issued under this tariff shall cover the following categories of public performance of the Society’s Repertoire: (i) Performance as an accompaniment to the exhibition of cinematographic films whether the repertoire is performed by means of the sound track of film or otherwise; (ii) Performance as an accompaniment to the exhibition of advertisement whether the repertoire is performed by means of the sound track of the advertisements of otherwise; (iii) Performance for intermission, play in, and play out purposes; (iv) Performance in a cinema foyer but only as a relay of music being performed in the auditorium or the music comprised in forthcoming attractions, provided that the foyer is not used as a café or otherwise with seating accommodation for the consumption of refreshment; (v) Performances in the form of not more than three items of variety entertainment introduced before, during or after each exhibition of the complete cinematographic film/audiovisual works programme. 2. EXCLUSIONS This tariff does not apply to performances of the Society’s Repertoire other than those expressly mentioned in paragraph 1 hereof, and any license granted by the Society under this tariff is subject to the condition that the License shall notify the Society of all entertainments or events with music held at the premises licensed under this tariff and shall pay all royalties due therefore in accordance with the appropriated tariff. 3. ANNUAL RETURNS Not later than 30 days after the end of a License Year, a License under this tariff shall furnish to the Society a statement, on such form as supplied by the Society, showing the Gross Receipts for that License Year. The statement should be either certified by an accountant who is qualified to be appointed auditor to a public company, or by an authorized officer of the License who shall prove the accuracy of the statement. 4. ANNUAL ROYALTY 4.1 Films /audiovisual works with no admission charge: (i) 15% on the aggregate hiring charges (including any charges for reimbursable and miscellaneous charges) payable to the venue management in respect of the film/audiovisual works; or (ii)MOP 0.86 per attendance per session of film/audiovisual works, whichever is higher, subject to a minimum royalty of MOP 773.73 per session of performance. 4.2 Films /audiovisual works with admission charge: 0.3% on the actual Gross Receipts with a minimum royalty of MOP 1,160.61 per session of performance. 4.3 In the mutual presence of 4.1 and 4.2, royalties will be the sum calculated in 4.1 and 4.2. 5. APPLICATON FOR LICENSES (i) Applications for a license under this tariff are required to give the Society such information on the Society’s appropriate form as may be necessary to enable the Society to decide whether this tariff is applicable. (ii) The Society is not bound to offer a license or permit under this in respect of any films unless application has been made in advance of the film. 6. DEFINITION For the purposes of this tariff: 6.1 “Society’s Repertoire” means all or any musical works and literary works which are lyrics to musical works, of which the right of public performance are or may be controlled by the Society or by any societies in other countries with which the Society is affiliated from time to time. 6.2 “License Year” means a consecutive period of twelve calendar months commencing on the first day of a month in which the license incorporating this tariff is executed. 6.3 “Gross Receipts” means all monies received or receivable as admission charges, in connection with any exhibition of cinematographic films to which this tariff applies, irrespective of whether such exhibitions are morning shows, mid-night shows or fund-raising shows, and where complimentary tickets are issued and accepted for any such shows, “Gross Receipts’ shall be deemed to include the total revenue such tickets would have yielded had the normal charges been made in respect of these tickets. |

ROYALTY RATES 2.1 All royalties are charged at the royalty rate in force at the beginning of the License Year, and are payable in advance of the License Year. 2.2 The annual royalty is calculated by reference to the screen surface area of the video wall (or display screen) and music content of the performance as stipulated in 2.2.1 and 2.2.2 respectively. The actual annual royalty payable is arrived at by multiplying the Basic Annual Royalty by Music Content Index together. 2.2.1 The basic royalty rates payable in respect of each video wall under this tariff for a License Year or part of a License Year are as follows:

1.SCOPE OF TARIFF This tariff applies to one-off music performances of the Society’s Repertoire in concerts, recitals, or any functions with live performance, whether or not a charge is made for admission to hear the music, in any place indoor and/or outdoor not otherwise adequately covered by a licence from the Society. 2.ROYALTY RATES 2.1 Functions with no admission charge: (i) 15% on the aggregate hiring charges (including any charges for reimbursables and miscellaneous charges) payable to the performing venue management in respect of the function, subject to a minimum permit fee of MOP 5,635.32 per session of performance; or (ii) Complimentary Tickets which are tributed to the specific public only(e.g: members or those who reached the consumption limit)
2.2 Functions with admission charge: (i) 2.2% on the actual Gross Receipts; and (ii) 1.1% on the Nominal Value of Complimentary Tickets; provided that where the Nominal Value of Complimentary Tickets exceeds 20% of the Full House Receipts Value, the portion of the Nominal Value of Complimentary Tickets in excess of the 20% will be charged at 1.65%, subject to a minimum permit fee of MOP 5,635.32 per session of performance. 3.APPLICATION 3.1 Applicants for a Permit under this tariff are required to give this Society such information on the Society’s appropriate forms as may be necessary to enable the Society to decide whether the tariff is applicable. 3.2 The Society does not undertake to offer a Permit under this tariff in respect of any performance unless: (i) Application has been made at least 15 days in advance of the performance; and (ii) The application should include information such as the seating plan of the premises, estimated Full House Receipts Value, price level of tickets, estimation of number and value of complimentary tickets given out, estimated hiring charges and reimbursable charges, estimated no. of attendance, and others as may be necessary to enable the Society to prepare the Permit. 4.PAYMENT PROCEDURES 4.1 The Permit executed by the applicant together with an advance payment on account must be delivered to the Society at least 7 working days before the first performance. Such a payment is calculated by applying the 2.2% rate to 70% of the Full House Receipts Value of the functions. Should the functions levy no admission charge, the royalty rates as stipulated in Clause 2.1 shall be adopted. 4.2 Final settlement of royalty must be made to the Society within 10 working days from the date of last performance supported by such documentation as an Auditors’ Report or report to the relevant government department showing the breakdown of actual Gross Receipts and Nominal Value of Complimentary Tickets issued. In the case of functions to which royalty rates of 2.1 applies, the Permit Holder must produce an Auditors’ Report showing the actual hiring and other charges and reimbursables or alternatively, the Permit Holder can produce copies of the account statements and receipts issued by the venue management in lieu of Auditors’ Report, a certified report of admitted head count should also be submitted. The Society shall refund any excess in royalty. 4.3 4.3The Permit Holder shall within 7 days prior to the date of the first performance furnish to the Society with the Programme Returns indicating the title, the duration and the name of the composers and lyric writers of each of the musical work to be publicly performed at each of the sessions pursuant to the Permit to enable the royalty paid hereunder to be distributed to the parties interested in those works. In the event that no such Programme Returns can be provided to the Society in the aforesaid manner, the Permit Holder shall, at least 7 days before the first performance, submit two complimentary tickets for each of the sessions of performance to this Society to facilitate the staff of the Society to verify, amongst other things, the musical works performed at functions. The Nominal Value of Complimentary Tickets for these tickets is excluded for the purpose of calculating royalty. 5.DEFINITION For the purposes of this tariff: 5.1 5.1The “Society’s Repertoire” means all or any musical works and literary works which are lyrics to musical works, of which the right of public performance in the Macau Special Administrative Region is or may be controlled by the Society or any societies in places other than the Macau Special Administrative Region with which the Society is affiliated from time to time. 5.2 5.2“Gross Receipts” means all money or monies received or receivable in respect of admission charges in connection with any sessions of performance to which this tariff applies. In the case of admission tickets to be sold at a discount, the face value before discount of these tickets shall be included in the “Gross Receipts”. 5.3 5.3“Full House Receipts Value”: In determining the amount of advance payment on account payable by the Permit Holder, the Society shall first calculate the amount of Gross Receipts the Permit Holder would have earned had all the tickets for the functions been sold at their full value. 5.4 5.4“Nominal Value of Complimentary Tickets”: Where complimentary tickets are issued by or on behalf of the Permit Holder in respect of the functions, the Permit Holder shall deem for the purposes of this Clause to have earned the amount equal to the actual Gross Receipts the Permit Holder would have earned had the tickets been sold at their full value without deduction. 5.5 5.5“Society” means Macau Association of Composers, Authors & Publishers (MACA). |

Remarks: 1.This tariff applies to performance of the Society’s Repertoire at retail shops, department stores & other common area for less than 3 months / 92days. 2.This tariff does not apply to: - Performances by means of a contrivance, such as a juke box, capable of being operated by the insertion of a coin or token; 3.Principles for the Tariff: 3.1 This tariff is based on the commercial value of music in the industry, the consumption level and the consumer price index of Macau, with the reference of the professional rules of the International Confederation of Societies of Authors and Composers (CISAC) and the royalty rates of affiliated societies in neighboring territories. 3.2 This tariff is under the strict supervision of the International Confederation of Societies of Authors and Composers (CISAC) and Deloitte Touche Tohmatsu, one of the four major international accounting firms. 3.3 The International Confederation of Societies of Authors and Composers (CISAC) is a non-for-profit and non-governmental organization which works closely with the World Intellectual Property Organization (WIPO) and the United Nations Educational, Scientific and Cultural Organization (UNESCO). |
